First Steps to Filing for Divorce in Fresno
The divorce filing process in California is well established and contains many facets that must be considered at the start and during the process of divorce. To file for divorce, the plaintiff must meet the residency requirements of the jurisdiction where the divorce is filed and at least one spouse must have lived in the state for six months and in the county for three months.
The start of the filing process is called the Petition for Dissolution of Marriage and it must declare the appropriate California grounds upon which the dissolution of marriage is being sought. During the divorce filing process you will navigate though many primary documents all of which are essential documents needed to file for dissolution of marriage according to California law. In addition, there are ten to twenty additional documents that may be required during the filing process.
When filing for divorce there are additional considerations beyond just the dissolution of the marriage contract. As California is a "Community Property" state, all property that was acquired during the marriage will usually be divided equally by the court. Other considerations are filing for support from one spouse to the other which is decided on a case-by-case basis. When minor children are involved in the filing process, the courts will do everything possible to help lessen emotional trauma the children may experience. If the parents cannot come to an agreement regarding the issues involving the children, the court will establish a custody order at its discretion. California child support guidelines are based on the Income Shares Model for calculating child support.
The filing process will start with the attorney asking questions about your case. Be prepared to talk about employment, significant property of the marriage, any history of dometic violence, history of abuse, or other potentially personal issues. The filing process is occasionally long and arduous; however the right law firm helping you during this process can make a positive distinction in the outcome of your case.
